Affiliate Program

 

Welcome to our Affiliate Program! By participating in our program, you agree to the following terms and conditions. Please read them carefully before you begin.

An affiliate is a partner who recommends Sunday Paloma in exchange for a commission on every successful referral and sale.

An affiliate is not somebody who carries and sells Sunday Paloma product from their own business or webpage.

1. Enrolment in the Affiliate Program

1.1. To enrol, you must submit a complete and accurate application via our website. We will notify you of your acceptance. We reserve the right to accept or reject any application at our discretion.

1.2. If we do not notify you of acceptance into the Affiliate Program within 14 days from your application, you may consider your application to have been rejected.

2. Affiliate Responsibilities

2.1. As an affiliate, you agree to follow our instagram and promote at least one of our customized stamps on your website, social media platforms, or other marketing channels at least once a month and tag @sundaypaloma_store on your post. Tags must be visible and clickable. 

2.2. Your special code for your followers must be shared on your social media account profile.

2.2. You are responsible for ensuring that your promotional activities comply with all applicable laws and regulations, including but not limited to advertising and marketing laws.

2.3. You must not engage in any fraudulent, unethical, or illegal activities, including but not limited to false advertising, spam, and unauthorized use of our trademarks.

2.4. If you received complimentary gift(s) from us for promotion, you must post photos of the products you received within 7 days of delivery. 

3. Commissions / Free gifts

3.1. Affiliate will earn a 5% commission on the sales of qualifying products purchased using their unique brand rep referral codes.

3.2. Sales are calculated as the total amount paid by the customer after discount, excluding taxes, shipping costs, and returns 

3.3. Commissions will be paid on a monthly basis, typically within 30 days following the end of the month in which the sale was made.

3.5. You will be eligible for free stamp if you make first sales to 3 different customers* within your first month (Please note that certain exclusions may apply; if you already received stamps when you first joined the program as a special promotion, you will not be eligible for additional stamps.)

3.6. Furthermore, if you have received our stamps as complimentary gifts or stamps purchased using your special code, it is necessary to showcase them by sharing photographs you have captured.

4. Payment Terms

4.1. Payments will be made via e-transfer end of each term (30 days).

4.2. You must provide accurate payment information to ensure timely commission payments. Any changes to your payment information must be promptly updated in your brand rep account.

4.3. A minimum commission threshold of $5CAD must be met before payment is issued. If the minimum threshold is not met, the commission will roll over to the next month.

5. Affiliate Codes and Marketing Materials

5.1. Upon acceptance into the program, you will receive a unique affiliate referral code for your followers and one time unique discount code for you. 

5.2. You may use our approved marketing materials, such as banners, logos, and product images, to promote our products. 

5.3. Any unauthorized use of our trademarks, logos, or other intellectual property is strictly prohibited.

5.4. Unique discount code for yourself must not be shared with anyone

6. Term and Termination

6.1. This agreement will begin upon our acceptance of your Affiliate application and will continue until terminated by either party.

6.2. Either party may terminate this agreement at any time, with or without cause, by providing written notice to the other party. 

6.3. Upon termination, you will cease all use of our trademarks, logos, and marketing materials and remove all affiliate links or codes from your website and marketing channels.

6.4. Any unpaid commissions accrued prior to termination will be paid to you within 30 days following the termination date.

7. Modification of Terms

7.1. We reserve the right to modify these terms and conditions at any time. Any changes will be communicated to you via email.

7.2. Continued participation in the affiliate program after any modifications constitutes your acceptance of the new terms.

8. Limitation of Liability

8.1. We will not be liable for any indirect, special, or consequential damages arising out of your participation in the brand rep program.

8.2. Our total liability for any claim arising out of or relating to this agreement will not exceed the total commission paid or payable to you under this agreement.

9. Governing Law

9.1. This agreement shall be governed by and construed in accordance with the laws, without regard to its conflict of law principles.

10. Miscellaneous

10.1. This agreement constitutes the entire agreement between you and us regarding your participation in the brand rep program and supersedes all prior agreements and understandings.

10.2. If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.
